These Terms of Service govern your access to and use of NovaGameHost websites, client areas, game-server hosting, support, and related services. By creating an account, placing an order, or using a service, you agree to these Terms, the Privacy Policy, Refund Policy, and Acceptable Use Policy.
1. Eligibility and accounts
You must be legally able to enter a binding agreement. You are responsible for accurate account information, safeguarding login credentials, and all activity performed through your account.
2. Services
NovaGameHost provides managed access to game-server hosting infrastructure and control-panel tools. Features, locations, supported games, hardware, and capacity may change as services evolve. We may perform maintenance, migrations, security work, or emergency changes when reasonably necessary.
3. Orders, billing, and renewals
Prices and billing intervals are shown before checkout. Hosting services renew automatically for the selected billing cycle unless canceled before the next renewal date. You authorize us and our payment processors to charge the payment method on file for applicable fees, taxes, upgrades, and renewals. Failed or disputed payments may result in suspension or termination.
4. Cancellation
You may cancel through the client area or by contacting support. Cancellation stops future renewals but does not automatically create a refund. Refund eligibility is governed by the Refund Policy.
5. Customer content and licenses
You retain ownership of content you upload. You grant NovaGameHost the limited rights necessary to store, copy, transmit, back up, and process that content solely to operate and support your service. You represent that you have all rights required for the content, mods, plugins, maps, files, and software you use.
6. Acceptable use
You must follow the Acceptable Use Policy and all game publisher, platform, and software license rules. We may investigate suspected abuse and suspend or terminate services that create legal, security, network, or operational risk.
7. Backups and data
Backups are a convenience and are not guaranteed to be complete or available. You are responsible for keeping independent copies of important server files, configurations, worlds, and databases. Data may be deleted after termination or expiration.
8. Availability and support
We work to provide reliable service, but uninterrupted or error-free operation is not guaranteed. Maintenance, upstream provider issues, software defects, attacks, capacity constraints, and events outside our reasonable control may affect service. Support response and resolution times vary by issue.
9. Suspension and termination
We may suspend or terminate service for nonpayment, fraud, illegal activity, policy violations, security threats, abuse of resources, or conduct that harms NovaGameHost, its providers, or other customers. Serious violations may be acted on without advance notice.
10. Disclaimers
Services are provided on an “as is” and “as available” basis to the fullest extent permitted by law. NovaGameHost disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the fullest extent permitted by law, NovaGameHost will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost data; loss of goodwill; or interruption of play. NovaGameHost’s aggregate liability for a claim will not exceed the amount you paid for the affected service during the three months before the event giving rise to the claim.
12. Indemnification
You agree to defend and indemnify NovaGameHost from claims, losses, and expenses arising from your content, your server, your violation of these policies, or your infringement of another person’s rights.
13. Governing law
These Terms are governed by the laws of South Carolina, without regard to conflict-of-law principles. Applicable consumer rights that cannot legally be waived remain in effect.
14. Changes
We may update these Terms. Material changes will be posted with a revised effective date. Continued use after an update constitutes acceptance of the revised Terms.
